Terms of Service

IMPORTANT NOTICE: PROHIBITION OF UNLAWFUL ACTIVITIES AND COMMERCIAL TRANSACTIONSPLEASE REVIEW THIS AGREEMENT CAREFULLY, INCLUDING THE ACCEPTABLE USE PROVISION BELOW, WHICH PROHIBITS ANY UNLAWFUL USE OF THE PLATFORM, INCLUDING ESCORTING, PROSTITUTION, COMPENSATED DATING, SUGAR DATING, AND HUMAN TRAFFICKING. ALL PAYMENTS THROUGH THE SERVICE ARE STRICTLY FOR ACCESS TO PLATFORM FEATURES AND SUBSCRIPTIONS ONLY—NO USER-TO-USER FINANCIAL EXCHANGES, ARRANGEMENTS FOR COMPANIONSHIP, OR COMMERCIAL TRANSACTIONS OF ANY KIND ARE PERMITTED OR FACILITATED. BY CLICKING «I AGREE» OR OTHERWISE ACCESSING OR USING THE SERVICE, YOU AFFIRM THAT YOU HAVE READ, UNDERSTOOD, AND CONSENT TO THESE PROHIBITIONS AND ALL OTHER TERMS.

Welcome to Citas Medellín (the «Service»), operated by Citas Medellín («we», «us», or «our»), based in Medellín, Colombia. Our contact email is info@citasmedellin.app and our platform is accessible at citasmedellin.app.

These Terms and Conditions («Terms») govern your access to and use of the Service. Citas Medellín is a dating platform designed to connect residents of Medellín, Colombia—including visitors and tourists—with each other for genuine, non-commercial romantic or social connections. The Service operates as a connection facilitator only: we do not provide in-app messaging. All communication between users takes place via SMS or WhatsApp once a connection is established through the platform. By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy (available at citasmedellin.app/privacy). If you do not agree, you must not use the Service.

1. Acceptance of Terms

1.1 Agreement

These Terms form a legally binding agreement between you and Citas Medellín. By creating an account, submitting information, or otherwise using the Service, you represent that you have read, understood, and agree to be bound by these Terms.

Acknowledgment of Prohibitions: As part of your acceptance, you specifically acknowledge the Acceptable Use provision in Section 3, which strictly prohibits any unlawful or exploitative use of the Service, including but not limited to escorting, prostitution, compensated dating, sugar dating, and human trafficking. You affirm that your use of the Service will comply with all applicable Colombian laws and these Terms.

1.2 Nature of the Service

Citas Medellín is a connection platform, not a messaging or communications service. The platform enables users to discover each other and express interest. Once a connection is made, all subsequent communication between users occurs outside the platform via SMS or WhatsApp. We do not monitor, store, or facilitate in-app messaging of any kind. By using the Service, you acknowledge and accept this model.

2. Eligibility and Accounts

2.1 Eligibility

You must be at least 18 years of age and legally capable of entering into binding contracts to use the Service. By using the Service, you represent and warrant that:

You are 18 years of age or older;

All information you provide is accurate, complete, and current;

You will not engage in any prohibited activities as outlined in Section 3;

You are not prohibited from using the Service under any applicable law.

We reserve the right to verify your age and identity at any time. We may also request additional documentation to comply with applicable Colombian law, including Law 1581 of 2012 (Habeas Data) and related data protection regulations.

2.2 Account Registration

To access the Service, you must create an account («Account»). During registration, you will be required to explicitly acknowledge and agree to the prohibitions on escorting, prostitution, compensated dating, sugar dating, and any financial exchanges with other users. You agree to:

Keep your Account credentials confidential and not share them with any third party;

Use your Account only for personal, non-commercial purposes;

Promptly notify us of any unauthorized access to your Account.

3. Acceptable Use of the Service

3.1 Permitted Use

You may use the Service solely for lawful purposes to connect with other users for genuine romantic or social interactions. The Service is intended to facilitate authentic, non-commercial connections between consenting adults. All interactions facilitated through the platform must be non-commercial in nature.

The Service does not process, facilitate, or support any direct or indirect financial transactions between users. Citas Medellín operates purely as a connection facilitator: we introduce users to each other, and all communication and arrangements thereafter are the sole responsibility of the individual users.

3.2 Prohibited Conduct

ZERO-TOLERANCE POLICY: The following activities are STRICTLY PROHIBITED and constitute a material breach of these Terms. Engaging in any such conduct will result in immediate termination of your Account, forfeiture of any prepaid subscriptions, and may result in reporting to appropriate Colombian law enforcement authorities and regulatory bodies.

Commercial Sexual Exploitation: Any form of compensated companionship, including but not limited to offering, soliciting, arranging, or exchanging money, gifts, financial support, «allowánces,» or other benefits for dates, meetings, companionship, or sexual services. This explicitly includes «sugar dating,» «pay-per-meet,» or any «pay-for-play» arrangements, and coded terms such as ‘mutually beneficial arrangement,’ ‘PPM,’ or ‘allowance’ implying financial exchange for companionship.

Human Trafficking and Sexual Exploitation: Any involvement in human trafficking, slavery, servitude, forced labor, or sexual exploitation, in violation of Colombian Law 985 of 2005 and Law 599 of 2000 (Código Penal Colombiano).

Financial Solicitation: Using the Service to solicit money or share payment handles, account details, or financial information in profiles, bios, or any user content, including but not limited to Nequi, Bancolombia transfers, PayPal, cryptocurrency wallets, or any other payment platform.

Illegal or Harmful Activities: Promoting violence, hate speech, non-consensual intimate images, or child sexual abuse material, in violation of applicable Colombian law.

Impersonation or Fraud: Creating false profiles, impersonating another person, or submitting misleading information.

Misuse of Contact Information: Using phone numbers or WhatsApp contacts obtained through the platform for harassment, spam, or any unlawful purpose.

3.3 Reporting Violations

If you encounter or suspect any prohibited conduct, report it immediately by emailing info@citasmedellin.app. We will investigate all reports promptly.

4. Subscriptions and Payments

4.1 Subscription Model

Access to certain features of the Service—specifically, the ability to send invitations to other users—requires a paid subscription («Subscription»). The current Subscription model is as follows:

Who subscribes: Male users subscribe to send invitations to female users. Female users may access the platform and receive invitations without a Subscription.

Subscription terms: Subscriptions are available on a monthly or annual basis. Annual subscriptions are offered at a discounted rate.

Auto-renewal: Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date. You will receive advance notice of any upcoming renewal.

No tiers or virtual currency: There are no premium tiers, coins, credits, or in-app purchases beyond the single Subscription product.

4.2 Payment Terms

All payments are processed through secure, third-party payment providers in compliance with applicable standards. You authorize us to charge your payment method for the applicable Subscription fee at the start of each billing period.

No User-to-User Transactions: The Service does not process or endorse any financial exchanges between users. All payments made through the Service are strictly for access to platform features only.

Asynchronous Privileges: In-app privileges (such as sent invitations) are processed asynchronously and may be fulfilled after an active subscription period has lapsed; no refunds or credits are provided for invitations resolved post-subscription.

No Refunds for Violations: If your Account is suspended or terminated for violation of these Terms, you forfeit all remaining Subscription periods and are not entitled to any refund or pro-rata reimbursement.

4.3 Third-Party Store Purchases

If you purchase a Subscription via the Apple App Store or Google Play Store, your payment is managed by that third-party store and their terms apply in addition to these Terms. All refund requests for such purchases must be directed to Apple or Google, respectively.

5. User Content

5.1 Ownership and License

You retain ownership of any content you submit, including photos and profile information («User Content»). By submitting User Content, you grant Citas Medellín a worldwide, non-exclusive, royalty-free license to use, host, and display it solely for the purpose of operating and improving the Service and enforcing these Terms.

5.2 Our Rights

We may review, remove, or edit User Content at our sole discretion, including for violations of these Terms or applicable Colombian law. We do not endorse or guarantee the accuracy or authenticity of User Content. We may delete accounts that have been inactive for six (6) consecutive months, defined as accounts that have not sent, accepted, or rejected any invitation during that period.

5.3 Copyright and DMCA Policy

We respect the intellectual property rights of others. If you believe that your copyrighted work has been copied and uploaded to our Service in a way that constitutes copyright infringement, you may submit a notification pursuant to the Digital Millennium Copyright Act (DMCA) by providing our Designated Copyright Agent with the following information in writing: (i) a physical or electronic signature of the copyright owner or authorized agent; (ii) identification of the copyrighted work claimed to have been infringed; (iii) identification of the material that is claimed to be infringing and where it is located on the Service; (iv) your contact information; (v) a statement that you have a good faith belief that use of the material is not authorized; and (vi) a statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

We reserve the right to terminate the accounts of repeat infringers.

6. Intellectual Property

The Service, including its design, code, algorithms, and branding, is owned by Citas Medellín or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from the Service without our prior written consent.

7. Privacy and Data Protection

Your use of the Service is governed by our Privacy Policy, available at citasmedellin.app/privacy. We process personal data in compliance with Colombian Law 1581 of 2012 (Estatuto de Protección de Datos Personales) and Decree 1377 of 2013. By using the Service, you consent to the collection and processing of your personal data as described in the Privacy Policy.

Because the Service does not include in-app messaging, we do not store or process message content between users. Phone numbers or WhatsApp contacts shared between users via the platform are provided voluntarily by users and subject to the privacy practices of those third-party platforms (SMS carriers and WhatsApp/Meta).

Authorization to Share Evidence for Disputes: In the event that you initiate a chargeback or payment dispute, you expressly authorize us to share relevant portions of your account data with your card issuer, bank, or payment processor, including connection history, IP access logs, and profile content necessary to demonstrate your usage of the Service, your acceptance of these Terms, or your violation of our Acceptable Use Policy.

8. Safety, Anti-Exploitation, and AI Disclosure

8.1 Anti-Trafficking Policy

Citas Medellín is committed to the prevention of human trafficking and sexual exploitation in compliance with Colombian Law 985 of 2005 and the Código Penal Colombiano. We conduct regular reviews of our platform and take immediate action upon detection of prohibited conduct.

8.2 Age Verification

The Service is strictly 18+. We reserve the right to implement age verification measures at any time and to suspend accounts where eligibility cannot be confirmed.

8.3 Communication Safety

Because communication between users occurs off-platform via SMS or WhatsApp, we strongly advise all users to exercise caution when sharing personal contact information. We are not responsible for communications, conduct, or arrangements made outside the platform. We strongly advise against sending money to any user you have met through the Service.

8.4 Artificial Intelligence (AI) Disclosure

In compliance with FTC guidelines and applicable consumer protection laws, we transparently disclose that Citas Medellín employs Artificial Intelligence (AI) and machine learning technologies to operate the Service. Specifically, we use third-party AI services (such as AWS Rekognition) for automated biometric face verification (liveness and face-matching) to prevent fraud, and automated image moderation AI (such as Sightengine) to scan user-uploaded photos for explicit, illegal, or prohibited content. By using the Service and submitting photos or selfies, you explicitly consent to the processing of your images by these AI systems for security, identity verification, and moderation purposes.

9. User Responsibility and Disclaimers

9.1 User Responsibility

You are solely responsible for your interactions with other users, both on and off the platform. Citas Medellín is a connection facilitator only and is not a party to, and bears no responsibility for, any arrangements, meetings, or conduct that occurs between users outside the platform. We explicitly do not facilitate, supervise, or take responsibility for communications conducted via SMS or WhatsApp.

No Criminal Background Checks: YOU UNDERSTAND THAT CITAS MEDELLÍN DOES NOT CONDUCT CRIMINAL BACKGROUND OR IDENTITY VERIFICATION CHECKS ON ITS USERS AS A STANDARD PRACTICE. We reserve the right to conduct such checks at any time if we deem it necessary for safety purposes.

Local Risks and Precautions (Medellín): We specifically acknowledge that there are known risks associated with meeting strangers in Medellín, Colombia, including well-documented crimes involving scopolamine («burundanga») or other incapacitating substances. You acknowledge these specific local risks and agree that you use the Service and meet others entirely at your own risk. The platform only facilitates introductions; it has no control over in-person conduct. Citas Medellín is strictly not liable for any physical harm, theft, extortion, or criminal acts committed by other users. You are strongly advised to take personal safety precautions, meet only in public places, do not leave food or drinks unattended, and independently verify the identity of the people you meet.

9.2 Disclaimers

The Service is provided «as is» and «as available.» We do not guarantee that the Service will be uninterrupted, error-free, or secure. We make no representations regarding the identity, intentions, or conduct of any user.

Health and Physical Safety: We do not screen users for medical conditions. You accept full responsibility for your personal safety and sexual health in connection with any interactions arising from use of the Service.

9.3 Limitation of Liability

To the fullest extent permitted by applicable Colombian law, our total aggregate liability for any claim arising out of or relating to the Service shall not exceed the total amount paid by you to Citas Medellín in the three (3) months preceding the event giving rise to the claim, or COP 500,000, whichever is greater. We are not liable for indirect, incidental, special, or consequential damages of any kind.

9.4 Indemnification

You agree to indemnify and hold harmless Citas Medellín and its affiliates, officers, and agents against all claims, damages, losses, and expenses (including reasonable legal fees) arising from: (i) your violation of these Terms; (ii) your User Content; (iii) your interactions with other users on or off the platform; or (iv) your violation of any applicable law or third-party rights.

10. Termination and Suspension

10.1 General Termination

We may suspend or terminate your Account immediately and without prior notice for any reason, including suspected violations of Section 3 or any applicable law. Upon termination for a violation, you forfeit all remaining Subscription periods and are not entitled to a refund.

10.2 Effect of Termination

Upon termination of your Account, your right to access the Service ceases immediately. Provisions that by their nature should survive termination—including Sections 3, 6, 7, 9, 11, and 12—shall survive.

11. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Colombia, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service shall first be addressed through good-faith negotiation between the parties.

Arbitration Agreement: If a dispute cannot be resolved through negotiation within thirty (30) days, all disputes arising out of or in connection with the present contract shall be finally settled under the Rules of Arbitration of the International Chamber of Commerce (or optionally through the Centro de Conciliación y Arbitraje de la Cámara de Comercio de Medellín) by one or more arbitrators appointed in accordance with the said Rules. The seat of the arbitration shall be Medellín, Colombia, and the language of the arbitration shall be Spanish (or English by mutual agreement).

Class Action Waiver: TO THE FULLEST EXTENT PERMITTED BY COLOMBIAN LAW AND APPLICABLE LAW, YOU AND CITAS MEDELLÍN AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A MEMBER OF ANY CLASS OR COLLECTIVE ACTION.

12. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Citas Medellín regarding the Service and supersede all prior agreements or understandings.

Severability: If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.

No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Force Majeure: We are not liable for any failure or delay in performance resulting from causes beyond our reasonable control.

Amendments: We reserve the right to modify these Terms at any time. We will notify users of material changes via email or notice on the platform. Your continued use of the Service following notification constitutes your acceptance of the revised Terms.

Language: These Terms are written in English. In the event of any conflict between an English version and a translated version, the English version shall prevail.
